11. Severability

If any provision of these Terms is deemed unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.

Tauranac, Inc. reserves the right to enforce these Terms. Violations may result in suspension or termination of access to the Website or App, and Tauranac, Inc. may pursue any legal remedies available.

13. Dispute Resolution through Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website or App shall be resolved exclusively by binding arbitration administered by a nationally recognized arbitration organization under its applicable rules, including the Optional Rules for Emergency Measures of Protection. You may choose to participate in the arbitration via telephone, written submissions, or in person at a mutually agreed-upon location. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Except as otherwise required by law, you are responsible for paying any arbitration filing fees and the arbitrator’s fees, while Tauranac, Inc. will cover all other fees and costs. This arbitration agreement does not preclude you from pursuing claims in small claims court.

14. In-App Purchases

Some features of the App may require an in-app purchase. For users who choose to purchase the premium features unlock (“Premium Upgrade”) available for a one-time fee through the Apple App Store:

  • Premium Upgrade: The purchase provides lifetime access to premium features on the specific Apple account used at the time of purchase.
  • Non-Refundable: All in-app purchases are final and non-refundable, except where required by applicable law.
  • Account Usage: The Premium Upgrade is tied to the Apple account used for purchase and cannot be transferred to a different account or device.
  • Restoration: If you reinstall the App or change devices, you can restore your Premium Upgrade by using the “Restore Purchases” option within the App.
  • Modifications: Tauranac, Inc. reserves the right to modify or discontinue premium features, but any in-app purchase providing lifetime access will not be retroactively affected by such changes.
